VICKSBURG, Miss. (AP) - A preliminary hearing for a 51-year-old Vicksburg man faces a capital murder charge in the 2008 shooting death of a retired assistant police chief has been rescheduled for January 7th.
District Attorney Ricky Smith, who is not related to the suspect, tells the Vicksburg Post that Wednesday's hearing was delayed because prosecution witnesses were unavailable due to the holiday.
Tyler Lee Smith is accused in the death of 75-year-old Walter Cole, a retired police officer. Authorities say Cole was robbed before he was killed and his body found in his car on a city street on July 23, 2008.
Smith is charged with capital murder.
