Convicted murderer released after 5 years

MADISON COUNTY, MS (WLBT) - A convicted murderer is released after serving just five years of a 20 year sentence. Now he's accused of killing again.

Thirty-five year-old Robert Harvey is charged with the January 8th stabbing death of 22-year-old Carmen Sanders. The murder occurred in the woman's Ridgeland apartment.

The prior murder occurred back in 1996. Ten years of Harvey's 20 year sentence for that crime were suspended and somehow he was released on probation after five years.

Madison-Rankin District Attorney Michael Guest did not prosecute the 1996 murder, but he tells us there's been a deviation from the truth in sentencing law that requires inmates to serve 85%  of their sentence.

"As our inmate population began to grow, it began to require additional money to house those inmates, and that 85% began being relaxed. This particular individual should have served 8.5 years of that sentence," Guest said.

Harvey was arrested on January 13th. He was being held in the Hinds County jail on petty theft at the time.
