VICKSBURG, Miss. (AP) - A Warren County grand jury has declined to indict a 51-year-old Vicksburg man in the 2008 death of a retired assistant police chief.
District Attorney Ricky Smith and Police Chief Walter Armstrong tell the Vicksburg Post that witnesses had changed their stories.
The grand jury convened this week.
Smith says four witnesses gave statements to the grand jury that contradicted their earlier statements to authorities.
Smith had been charged with capital murder in the shooting death of 75-year-old Walter Cole.
Authorities say Cole was robbed before he was killed and his body found in his car on a city street on July 23, 2008.
