Alleged cop killer not indicted

VICKSBURG, MS (WLBT) - Four months after police thought they'd cracked the cold-case killing of a retired police officer, the case has run cold again.

They had initially charged Tyler Lee Smith with capital murder in the death of Walter Cole, a retired deputy police chief. Cole had been shot in the head while sitting in a car near his home in the summer of 2008. Smith was arrested, but last month, a grand jury failed to indict him after a key witness recanted her story.

Assistant Police Chief Jeffery Scott believes someone convinced her to change her testimony. "Vicksburg is a small place. I think that this witness was threatened. She alluded to that, but as far as her cooperating where we could substantiate that allegation, that just never took fruition," Scott said.

Cole had been robbed before he was shot. Other than Smith, no one has been charged in Cole's death.
