VICKSBURG, MS (WLBT) - The verdict is in for a state trooper who has been on trial in Vicksburg.
Forty-seven year old Dane Davenport was accused of molesting two teenage boys.
Just after 7p.m. Friday evening jurors found Davenport not guilty of five counts. They were deadlocked and a mistrial declared in the last four counts of an indictment that accused Davenport of raping and fondling the boys. The jury deliberated for five hours.
This is the fourth time in almost two years that Davenport has been tried on the charges.
"Of course we'd like this fight to end in this courthouse and be over with and maybe as we all separate and catch our breath maybe we can come to some kind of resolution of this fight that has gone on for almost 3 years now," John Zelbst, Davenport's attorney said.
Davenport's first trial in 2008 ended in mistrial. He has been on unpaid administrative leave from the Highway Patrol since his arrest and indictment. The state attorney general's office prosecuted this case against Davenport.
