JACKSON, Miss. (AP) - The state Court of Appeals has ordered a new trial for a Jackson woman convicted in a 2007 slaying.
The Appeals Court on Tuesday ruled a Hinds County judge erred in barring jurors from considering whether to convict Mary Lewis of the lesser crime of manslaughter.
Lewis was convicted of murder and sentenced to life in prison in 2008 in the shooting death of her boyfriend, Arthur Patterson. Patterson was killed in June 2007.
The trial judge had ruled the evidence in the case did not justify allowing the jury to consider a lesser charge.
The Appeals Court said the facts of the case showed Lewis may have acted in the heat of passion and the issue was one that jurors should have been able to consider.
