Madison Supervisor accused of leaking information in lawsuit

MADISON COUNTY, Miss. (WLBT) - Information has been leaked from closed Madison County Board meetings to the Mississippi Department of Transportation, according to Board President Tim Johnson.

"We had a problem in Madison County in regards to information coming from our executive sessions," said Johnson.

He was pointing the finger at Supervisor D.I. Smith. 

"I'm not leaking information," said Smith.

It has to do with a $20 million lawsuit from the Board of Supervisors against MDOT for the Reunion Parkway Project.

"He is in essence is trying to hurt our chances to get money back to tax payers of this county where we can use it for roads and other infrastructure needs," said Johnson.

Board attorney Eric Hamer said MDOT's attorney, Roy Tipton, alerted him to the leak.

Hamer shared some, but not all of the emails between Supervisor Smith and MDOT Commissioner Dick Hall and his staff.

It shows Smith forwarded draft minutes several days before the documents would be made public. 

WLBT did not see any emails that contained private information.

"I'm very open, responsible, but as far as doing anything improper I'm not aware of anything like that," said Supervisor Smith.  "I think this is simply politics in Madison County."

Johnson says they will no longer hold executive session meetings regarding the lawsuit while this matter is looked into further.

"We just can't trust him to keep that information to himself and that's sad," said Johnson.

Hamer told us that he will be consulting with the Attorney General's office to see if Smith made any ethical violations.

WLBT contacted MDOT to speak to attorney Roy Tipton and were only told "the case between the Madison County Board of Supervisors and MDOT is in litigation."
