JACKSON, MS (Mississippi News Now) -

Mississippi Attorney General Jim Hood is claiming victory in a Medicaid fraud suit that's been going on since 2005.

Hood said Judge Thomas Zebert found in favor of the State of Mississippi in its case against pharmaceutical company Sandoz, Inc., to the tune of more than $38 million dollars.

The attorney general's case showed Sandoz submitted inflated prices to a drug pricing publisher which the states followed to determine how much they should reimburse pharmacies.

Hood said "...padded prices, so that they pharmacist could make more as well as they could turn around and sell more of the drugs because the pharmacists making more, they're naturally going to fill that prescription with one of their type drugs with a generic. That's what they do, they manufacture and sell generic drugs."

Hood says the company will probably appeal.

Mississippi has settled with eight other pharmaceutical companies for a net of nearly $39 million dollars.
