Cyberstalking charge against Stuart Irby dismissed

A local blogger reports a cyberstalking indictment against Jackson businessman Stuart Irby has been dismissed.

The Jackson Jambalaya website states Madison County Circuit Judge John Emfinger dismissed the indictment Wednesday.

Irby was indicted for cyberstalking Lehman Bounds, the third, ex-husband of Karen Irby, after Stuart Irby sent a picture of Bounds' 17-year-old daughter to Bounds. The picture had been photo-shopped on the upper body of a swimsuit model.

In an independent psychiatric evaluation requested by the district attorney, a doctor said, in part, Irby suffered from "severe, permanent brain injury" and is "incapable of making reasoned decisions."

Irby and his wife, Karen were injured in a 2009 crash that killed two doctors.
