The family of a Madison police officer killed in a traffic accident last March has filed a lawsuit. Officer Jimmy Brooks, Sr., died after he hit a piece of construction equipment on his motorcycle at Hoy Road and U.S. 51.
Eyewitnesses had initially said Brooks, who was riding his personal motorcycle to work, went around a brick truck, pulling into a construction site when he hit a piece of equipment in the dark.
The family filed the lawsuit March 22, 2012, against Tanner Construction Company of Ellisville and Warren Excavation of Madison.
In part, the suit claims the mini excavator involved in the accident should not have been on Highway 51, and that the companies failed to take proper precautions such as having a flagman on the roadway.
