JACKSON, MS (Mississippi News Now) -

A former Jackson police officer charged with the capital murder of his infant daughter was in court Wednesday. Natyyo Gray is accused of the November 2011 beating death of 1-year-old Aubry Zoe Brown.

Gray went before Judge Jeff Weill for a bond hearing but had to withdraw the motion when a witness was unable to make it to court.

Phyllis Brown, the mother of the child, was expected to testify on Gray's behalf.

During a preliminary hearing, a Jackson police detective testified he saw bruising on the child's forehead and a large lump on her head in addition to an abdominal bruise.

"We were not able to obtain her appearance today for various reasons I won't go into regretfully, rather than display to everyone on behalf of my client his innocence, today is not the day for that," said Gray's attorney Paul Koerber.

Hinds County District Attorney Robert Smith says his office is still recommending Gray be held without bond. They say they will proceed with their case.
