JACKSON, MS (Mississippi News Now) -
The prosecution rested Tuesday afternoon in the capital murder trial of Bennie Gunn.
The defense is not calling any witnesses.
Bennie Gunn is accused in a 2010 crime spree, which included the murder of a delivery man at a convenience store and the shooting of a 12-year-old during a robbery at the E.Com Lodge in south Jackson.
Witnesses testified against Bennie Gunn saying they've been subjected to verbal and physical threats in recent days.
Jackson Police Detective Eric Smith testified that a witness told him about three separate threats against her. In one instance she said a woman stabbed her in the hand during an attack at her home, warning her about testifying against Gunn. Another came in the form of a phone call from Gunn himself, from his jail cell.
"She informed me that the phone call was made to her this past Saturday and it was through a 3 way phone conversation," said Smith.
She also claims she was verbally threatened by Christopher Gunn, Bennie Gunn's brother, inside the courthouse.
Detective Smith arrested Christopher Gunn and charged him with witness tampering, but that information was withheld from the jury.
Bennie Gunn is charged with capital murder, carjacking, aggravated assault and armed robbery.
