Man gets 40 years in fatal shooting of girlfriend's ex

Hinds County Circuit Judge Jeff Weill has sentenced 48 year old Dillard Harvey of Jackson to a total of 40 years in prison. Harvey was convicted by a jury last February first of manslaughter, being a convicted felon in possession of a firearm and use of a firearm in the commission of a felony.

Harvey was convicted of shooting 28-year-old Aaron Yates to death. It happened in February of 2011 on Robinson Road in Jackson.

Jackson police said 28-year-old Aaron Yates went to his ex-girlfriend's house and her current boyfriend Dillard Harvey answered the door.

The two reportedly got into an argument and struggled over a handgun before Yates was shot once in the chest while attempting to flee.

Harvey had been charged with murder but the jury reduced it to manslaughter.

"The maximum sentence available for manslaughter is 20 years in prison, and I so sentence you," said Judge Weill. "You took every thing Aaron Yates had, and all he hoped to have. You lost your cool and grabbed your gun. And look what you have done. Shame on you."

Judge Weill also gave him an additional 20 years for being a convicted felon in possession of a fire arm and use of a firearm in the commission of a felony.
