Lawsuits stemming from the recent Stryker hip recall are moving forward in a consolidated litigation established in New Jersey Superior Court, Bergen County, Bernstein Liehbhard LLP reports. According to court documents, Judge Brian R. Martinotti has scheduled the litigation’s initial conference for February 20, 2013 at 10:00 a.m. (In re Stryker Rejuvenate Hip Stem and the ABG II Modular Hip Stem Litigation, No. 296 (N.J. Super. Ct., Bergen Cty.)

Stryker Hip Recall
Stryker recalled its Rejuvenate and ABG II modular neck-stems on July 6, 2012, due to a potential for fretting and corrosion at the modular-neck junction that may result in pain, swelling and adverse local tissue reactions. The Stryker consolidated litigation in New Jersey was established last month, after plaintiffs in Stryker hip recall lawsuits petitioned the New Jersey Supreme Court in September. All of the claims pending in the litigation allege Stryker marketed a defective product and failed to warn patients about the risks associated with the Rejuvenate and ABG II stems.
In its most recent recall update, Stryker advised patients fitted with the recalled components to undergo metal ion testing and cross sectional imaging, even if they are not experiencing symptoms of a failing hip implant. According to the company, some individuals affected by the Stryker hip recall have experienced high levels of metal ions in their blood and/or adverse local tissue reactions, even in the absence of symptoms.* Stryker also announced that it has retained Broadspire Services, Inc., a third-party claims administrator, to work directly with patients to manage medical claims and address out-of-pocket costs relating to the Stryker Rejuvenate recall.** Bernstein Liebhard LLP is advising patients that they should consider speaking with an attorney before they begin the Broadspire Stryker claims process, as any information they disclose to a Broadspire representative or in the course of the claims process could be used as evidence in their Stryker hip recall lawsuit.
