Hearing set for Tiede case

CARTHAGE, TX (KSLA) -

Few details behind the reason for convicted killer Bernie Tiede's move from prison back to jail in Panola County last week were revealed in a hearing Wednesday.

Tiede was convicted of shooting and killing Marjorie Nugent in November 1996, then hiding her body in a freezer. In 1999, Tiede was sentenced to life in prison for the Nugent's killing.

He's been serving out his time at New Boston's Telford Unit until last week, when a bench warrant was issued ordering him returned to Panola County. All officials at the Panola County Sheriff's Office could say about the reason for the move was that it had something to do with new evidence in the case.

The district attorney and Tiede's attorney have yet to comment.

Tiede's new attorney, Jodie Cole, reportedly organized an interview between Bernie and a psychiatrist that uncovered Bernie had been abused by a family member when he was a teen, which could have contributed to his violent behavior.

That psychiatrist also reportedly called Tiede an exemplary prisoner and said, "it is extremely unlikely that…Mr. Tiede would ever commit any similar act in the future."

Now, The Panola Watchman is reporting that a 1 p.m. hearing has been set for Wednesday, Feb. 5, to hear matters in Tiede's appeal.

The Watchman also reports that documents filed late Thursday afternoon include the official recusal of Judge Charles "Brick" Dickerson and the appointment of Judge Diane DeVasto.

DeVasto was appointed to hear Tiede's appeal after Judge Dickerson recused himself because he previously represented Marjorie Nugent's estate against Tiede.

DeVasto was appointed by Judge Mary Murphy of the First Administrative Judicial Region.
