Attorney for suspect in Vanderbilt rape case may ask to move trial

The attorney for one of the suspects in the Vanderbilt rape case says he may fight for a change of venue because he says his client can't get a fair trial now.

Cory Batey's attorney believes someone close to the case is leaking information about confidential evidence with the public. Batey is one of four former Vanderbilt football players accused of raping an unconscious woman in a campus dorm last summer.

His attorney, Worrick Robinson, wouldn't go into detail about what that evidence is because he says it shouldn't be heard outside the courtroom.

"It would be an attempt to sway the public opinion by releasing just bits and pieces of what occurred or just one person's perspective, and that's scary," Robinson said.

Robinson says he wants his client tried separately from co-defendant Brandon Vandenburg and he may now fight to get the trial moved out of Davidson County.

Batey's attorney says those involved with the case agreed not to share details with the public about the evidence. Now that that agreement has been violated, Robinson says a judge will likely issue a gag order.
