CANTON, MS (Mississippi News Now) -

An assault case involving a Madison County Justice Court Judge will head to the grand jury. The local chapter of the NAACP claims the judge assaulted a Canton native with a mental disability while the Judge was on duty as a private security guard.

The alleged incident took place on the square May 8th in Canton. The president of the Canton NAACP says 20 year old Eric Rivers was allegedly assaulted by the District 3 Madison County Justice Court Judge.

According to Dr. William Truly, witnesses report it as an unprovoked incident.

"He was allegedly slapped, kicked and called Nigger by Madison County Judge Bill Weisenberger, who at the time was moonlighting as a private security guard," said Truly.

Judge Weisenberger was unavailable Friday when we  went to the Madison County Justice Court to get a comment from the judge.

Madison County District Attorney Michael says the Canton Police Department has turned the case over to his office. The matter will be presented to the Grand Jury.
