James Osgood sentenced to death in Chilton County

James Osgood, the man convicted of murdering 46-year-old Tracy Brown in 2010, has been sentenced to death.

Judge Sibley Reynolds handed the sentence down on Friday. The judge remarked during the sentencing that this case involved the darkest set of facts he had ever dealt with.

Osgood expressed little emotion during the sentencing.

Osgood and his girlfriend, Tonya Van Dyke, were accused of killing Brown inside of her Clanton mobile home on October 2010. Tonya Van Dyke and Tracy Brown were cousins.

Authorities say Brown was beaten and sexually abused before her throat was slit. In May of this year, the jury found Osgood guilty of two capital murder charges and recommended the death penalty.

Photos produced during the trial showed where brown was cut repeatedly across her throat, as well as two stab wounds in the back.

"It's clearly evident from the photographs the terror she went through and the horrors she experienced prior to her death," Chilton County District Attorney Randall Houston said.

Houston has been in the DA's office since 2001. He says this is only the fourth occurrence of his office seeking the death penalty in that time.

"We thought it was justified from the very beginning. And I think that anybody who sat through the trial and saw the photographs of Tracy Brown in the aftermath of her murder would agree with us," Houston said.

Brown's stepmother, Jackie Wileman, testified during the sentencing. She testified to the sorrow of losing a loved one and wanted the judge to take note of the pain and suffering that the victim went through.

"It's so hard to realize what a human being would do to another. It's really hard to swallow," Wileman said.

Osgood's defense team presented evidence of how he and his sister were physically and sexually abused. Osgood's mother was a drug addict and prostitute who was murdered when he was a child.

This did not change Chilton County Judge Sibley Reynolds' ruling for the death penalty. Reynolds says due to the dark facts of the case, he had little choice.

The case will be automatically appealed and Brown's family is vowing to be present during the appeals process.

"Our family and Tracy did not deserve what she got. That's just horrible," Wileman said.

Van Dyke, who is also facing capital murder charges, was present during the sentencing. Her trial is set to begin in December.
