LINCOLN, NE (CNN) - A Republican congressman responded on Saturday to criticism that a law he backed is partially responsible for the current crisis at the border.

An act passed in 2008 provided protection for unaccompanied minors who enter the country illegally from nations that do not border the U.S.

U.S. Rep. Jeff Fortenberry, R-NE, sponsored the legislation.

He said President Barack Obama is to blame for the present crisis.

"I was very proud to be a part of the sponsoring of the Victim's Rights...Human trafficking is a modern form of slavery. It is discouraged for humanity, and America must project its values and protect vulnerable persons so I was very proud to be a part of this 2008 law,” he said. “This problem with the surge of children and families at the border did not occur until 2013, did not occur in 08, 09, 10, or 11. Five years after this. The reality is this is a convergence of factors of desperate poverty, ungoverned space as well as an exploitation of our laws.”

The congressman then said that Obama encouraged the migration in 2012.

“And the president fostered an environment where in 2012 he said deportations were going to decrease, and I think that was a corollary to exploitation of this law and other factors that have led to this sad, sad situation along the border,” he said. “Let me add this as well, I think it's unconscionable that the president would go to Texas for a fundraiser and a photo op but not visit our border. Communities are suffering, children are suffering and our immigration policy is in disarray. He should be in the White House preparing a speech to the nation about how we are going to get this back under control.”

Fortenberry says Obama should send National Guard troops to assist border patrol.
