Madison County parents file freedom of speech lawsuit

A freedom of speech lawsuit has a few folks talking in Madison County. It revolves around texting nude photo's of a student and expulsion. This lawsuit was filed September 18th in Federal Court by a Ridgeland attorney.

The parents of an expelled Germantown high student are taking the action. It states on January 15, 2014, a female student took a nude photo of herself then sent it to other students at school. It was then forwarded to a student identified as J. B. In the lawsuit.

Using his home computer, the lawsuit states, J. B. Uploaded the nude photo with the title of "Germantown whores" on Instagram. The following day J. B. was attending class at Germantown High School and during the break from one of his classes he uploaded a copy of the nude photograph to the Instagram page entitled "Germantown Whores."

The principal investigated and determined J. B. was the student who posted the photo and suspended J. B. immediately. The student was later expelled, and sent to the Madison County alternative school for 6 months.

J. B. will not be allowed back at Germantown high school until January of 2015. His parents say this was a violation of his constitutional right to free speech. The family is suing the Madison County school district for $200-thousand in actual damages and $200-thousand in punitive damages.
