JACKSON, Miss. (AP) - The state Court of Appeals has upheld the murder conviction of a Brandon man sentenced to life in prison in the death of his girlfriend.
Robert Floyd McGuire was convicted in Rankin County in 2012 in the slaying of 61-year-old Linda Tate.
Authorities say the shooting occurred Dec. 3, 2011, at the couple's Brandon home.
Police say Tate was shot once in the head with a small caliber pistol.
McGuire argued on appeal that he was the sole eyewitness and that his version of the events that the shooting was accidental was reasonable.
The Appeals Court, in Tuesday's ruling, said McGuire's version of what happened was contradicted by the physical facts, including testimony that there were three safety measures on the pistol so that it could not be accidentally discharged.
