Suit against JSU athletics director heads to federal appeals court

JACKSON (AP) - A former employee at Jackson State University has appealed the dismissal of her sexual harassment lawsuit against athletics director Vivian Fuller to a federal appeals court.
    
The 5th U.S. Circuit Court of Appeals will hear oral arguments in the lawsuit on Feb. 5 in New Orleans.
    
The lawsuit, which was tossed out last March, was filed by Fuller's former secretary, Lolita Ward.
    
Ward alleged that Fuller subjected her to inappropriate comments, gestures and touching in 2011. The lawsuit argues Ward was fired in October 2011 after rejecting the advances.
    
But U.S. District Judge William H. Barbour Jr. said Ward failed to prove any of her allegations.
    
Ward wants the case to go to trial. She argues in her appeal issues she raised against Fuller should be decided by a jury.
