Federal Judge hears arguments in state flag lawsuit

Federal Judge Carlton Reeves heard arguments Tuesday in a lawsuit filed by a Mississippi Lawyer against Governor Bryant over the state flag.

Carlos Moore, from Grenanda, filed the lawsuit naming Governor Phil Bryant that sought the removal of the current Mississippi state flag, which includes a Confederate battle emblem from all public display in the state.  

The lawsuit asserted the state flag violates the Equal Protection Clause of the 14th Amendment.  Moore also said the state flag is state approved discrimination and says it's actually causing him physical injury. 

"My health has been affected. My hypertension has been worsened, it's been exasperated, my insomnia, as well as my heart rate is abnormal," Moore explained.

Moore said his injuries worsened after seeing racially motivated events like the vandalism of James Meredith Statue and the South Carolina killings.

"You had 9 people killed by a white supremacist. Surely if the first state that exceeded from the union had the decency to take the flag down, surely Mississippi will do so," Moore explained.

Attorneys for Governor Phil Bryant say Moore's claims do not prove he was personally subjected to discriminatory treatment and the state flag is not an issue for federal court.  Judge Carlton Reeves questioned both sides Monday and raised the attention on the Mississippi flag vote back in 2001.

Judge Reeves did not rule Tuesday on whether the lawsuit can go forward. He said he will review arguments and make a decision at a later date.
