Sen. Burton's charge was for 2nd offense DUI

JACKSON, Miss. (AP) - A Mississippi lawmaker's arrest last weekend was on a second-offense DUI charge.

An arrest record released Wednesday by the Mississippi Highway Patrol shows Sen. Terry Burton of Newton registered a .10 percent blood alcohol content in a breath test Saturday night. The limit in Mississippi is .08 percent.

Highway Patrol Capt. Johnny Poulos said Monday that Burton was charged with DUI after running a sport utility vehicle off of Interstate 20 and hitting a sign in Scott County.

Burton said Wednesday that his attorney had advised him not to publicly discuss the charge.

The 60-year-old Republican has been in the Senate since 1992. He represents District 31 in Lauderdale, Newton and Scott counties.

In January, Burton's colleagues chose him as president pro tempore, the second-ranking leadership role in the Senate.
