Federal Judge rules on state flag lawsuit

JACKSON, MS (Mississippi News Now) -

A federal judge has dismissed a lawsuit challenging the constitutionality of the Mississippi state flag.

Judge Carlton Reeves dismissed the case Thursday, saying attorney Carlos Moore  failed to show the Confederate battle emblem had caused “cognizable legal injury”.

Moore filed the suit in February asking Reeves to declare the flag an unconstitutional relic of slavery. It is the last state flag in the nation with the emblem.

Moore says he is relieved his family will no longer have to endure death threats. He currently has around the clock security. Moore told us he is in talks with his attorney to decide whether to appeal the case. He says he will make that decision Friday. 

Governor Phil Bryant issued a statement on his Facebook page saying he is pleased with the decision and what the state flag is or is not should be decided by Mississippi voters.
