Mayor Yarber files response to sexual harassment lawsuit

Mayor Tony Yarber, through his attorney, has answered a sexual harassment lawsuit filed by former Executive Assistant Kimberly Bracey back in August.

Yarber asks the court to dismiss the lawsuit with prejudice and require Bracey to pay him damages. In his "Affirmative Defense" Yarber refutes all of Bracey's allegations.

In her filing, Bracey said she had been subjected to sex discrimination, sexual harassment, a sexually hostile work place and has been unlawfully retaliated against in the terms and conditions of her employment with the City of Jackson.

Bracey was hired by the City of Jackson on April 24, 2014 as an Executive Assistant to the Mayor. This made Yarber in a position of direct authority over her.

In May of 2014, Bracey separated from her husband and moved in with Monica Joiner, a City Attorney for Yarber and the City of Jackson.  At the time, Bracey and Joiner were "actively pursuing a sexual relationship with Defendant Yarber," according to the document filed.  

Though Bracey knew of his numerous relationships with other women at the time, she declined to tell Joiner.  

In July of 2014, Bracey ended her relationship with Yarber and reconciled with her husband. She moved back in with her family.

According to Bracey, when the relationship ended, Yarber transferred her so that she would be supervised by other staff. She said he forced her to continue their sexual relationship by threatening to fire her if she didn't have sex with him.

Bracey said that she was the main source of income for her family and was afraid if she was fired she wouldn't be able to find comparable work.

On April 27, 2015 Bracey was fired by Mayor Yarber. He said that she violated a work rule by unauthorized use of city equipment. She claims that it was ultimately because she refused the sexual advances of Mayor Yarber.
