JACKSON, MS (Mississippi News Now) -

One of two men convicted in the beating death and robbery of a Vicksburg welder will stay behind bars.

31-year-old David Thomas was convicted of capital murder and sentenced to life in prison in 2016. Fred Jackson was beaten and robbed in 2012.

Jackson police recovered surveillance video from outside The Can Man on Woodrow Wilson Drive in Jackson where the victim was attacked.

Fred Jackson was in a hospital for 41 days before he died.

In Thomas' appeal to the State Supreme Court, he claims the state failed to cite evidence to support the jury's verdict and that the court excluded his expert witness.

Mississippi Supreme Court Justices denied his appeal Thursday.
